Feds drop sex abuse case against Syracuse's Fine

SYRACUSE, N.Y. (AP) ? Federal authorities have dropped their investigation into sexual abuse claims that cost a Syracuse University assistant basketball coach his job, threw a top-ranked team into turmoil and threatened the career of Hall of Fame coach Jim Boeheim.

After a probe spanning nearly a year, U.S. Attorney Richard Hartunian said Friday there was not enough evidence to support claims that Bernie Fine had molested a boy in 2002 in a Pittsburgh hotel room.

"The nature and seriousness of these allegations, which involved conduct typically committed in private with individuals who are reluctant to come forward, warranted a thorough federal investigation," Hartunian said.

It wasn't clear yet whether Fine, 66, could get his job back.

His lawyers, Karl Sleight, Donald Martin and David Botsford, said in a statement that they were not surprised by the decision.

"The damage inflicted upon Bernie and his family is simply immeasurable," the lawyers said. "Bernie hopes and prays that the lesson learned and remembered is that a rush to judgment has irreversible consequences."

The investigation erupted in the glare of a spotlight on child abuse shone by the Penn State University scandal that broke shortly beforehand. Two former Syracuse ballboys, Bobby Davis and Michael Lang, came forward Nov. 17 and accused the longtime assistant of fondling them when they were teens. Davis said the sexual contact continued for years.

But the claims by Davis and Lang had happened too long ago to be prosecuted. Ten days later, though, a third man, 23-year-old Zachary Tomaselli, of Lewiston, Maine, went public with an accusation that Fine had molested him in 2002 in a hotel room when the team played in Pittsburgh. The same day, ESPN aired an audiotape in which Fine's wife, Laurie, apparently acknowledged to Davis she knew about the molestation he alleged.

Fine, who denied the allegations, was fired Nov. 27, and the federal government began investigating Tomaselli's claim, the only one that fell within the statute of limitations. The federal statute of limitations that went into effect in 2002 allows prosecution until the victim reaches age 25; Tomaselli was 23 when he made his claims.

Hartunian, in his statement, said closing the investigation doesn't mean something did or did not happen, only that there wasn't enough admissible evidence to get a conviction. He said that people should come forward with tips if they have any more information.

Davis had made the same accusation against Fine to the university and Syracuse police a decade before, but the police couldn't investigate because of the statute of limitations, and the school said its probe turned up no evidence of wrongdoing. Davis did not immediately return a call seeking comment Friday.

From the start, there were doubts.

When Davis and Lang came forward in November, Boeheim angrily defended his assistant of 35 years and said the accusers were only out for money, seeking to cash in on the publicity generated by the Penn State scandal, in which former assistant football coach Jerry Sandusky was charged with sexually abusing several boys.

Another accuser, Floyd Van Hooser, said Fine abused him for years but later said he was lying.

That left Tomaselli, who was himself accused of sexually abusing a boy at a camp in 2010 and whose father had said the boy was lying. Tomaselli was eventually convicted of sexual abuse and started a prison sentence of three years and three months in April.

Before he went behind bars, Tomaselli took the media on a wild spin, repeatedly lying in a bid, he said, to keep his name in print:

? He said Fine had made harassing phone calls to him, and Tomaselli got an order of protection. Then he said that was a lie.

? He said he had lied about the whole thing, that Fine had never touched him.

? He reverted to his old claim and insisted Fine abused him.

Tomaselli is serving a prison sentence of more than three years in Maine and could not be reached for comment. His lawyer, Justin Leary, was in court and could not immediately respond to a request for comment.

There were other sordid claims to come out, including that Fine's wife had sex with players and that Boeheim knew, or should have known, of his assistant's behavior.

While his No. 1-ranked Orange continued to rack up wins ? they wouldn't drop their first game until Jan. 21 ? Boeheim endured criticism and scrutiny and was questioned during news conferences about the case.

Boeheim, who just completed his 36th year coaching Syracuse, vehemently supported his longtime assistant when the accusations broke and said Davis was lying. "The Penn State thing came out, and the kid behind this is trying to get money," he told the Syracuse Post-Standard.

Amid criticism from victims' rights advocates, Boeheim apologized and said he spoke out of loyalty and was basing his comments on a 2005 university investigation that failed to corroborate Davis' claims.

Boeheim referred questions to the university's press office. University spokesman Kevin Quinn said that Syracuse appreciated the work done by the U.S. attorney's office and that the decision to fire Fine was appropriate.

"It was made in the best interest of the university," Quinn said.

Davis and Lang sued Boeheim and the university for defamation, but a judge dismissed the lawsuit, saying Boeheim's defense of his friend was clearly opinion. Gloria Allred, the lawyer who represented the two men, did not immediately comment.

Fine, who put his Syracuse home on the market in March, has been in Florida and was recently hired as a consultant for an Israeli basketball team.

Laurie Fine has sued ESPN, alleging defamation and claiming the network knew that Davis was lying and ruined her life. That suit is pending.

The university's prompt response to the allegations was done in good faith but was flawed because, among other things, there was no direct contact with law enforcement, a special committee of the university's board of trustees said in a report released in July.

Davis met Fine in the early 1980s at a park that was a basketball hangout for kids in a working-class neighborhood. After he became a ball boy in 1983 around age 11, Davis said, he went everywhere with Fine.

Fine turned into a father figure, and as Davis spent more time at the older man's house ? actually living there sometimes ? the abuse escalated from touching outside the pants to inside, according to Davis.

During an interview in December with The Associated Press, Davis said the abuse would sometimes occur in Fine's campus office with secretaries just beyond the closed door, at Syracuse basketball camp and at a fraternity house.

Some of the abuse would occur in Davis' bed in Fine's basement while Fine's wife was home, Davis said.

Channeling Erma | INSANITY OF MOTHERHOOD motherhood ...

Recently my new friend Joanne mentioned my blog reminds her of humor writer Erma Bombeck.? She said she likes my story telling which she feels is very much like Erma?s.? Needless to say, I was flattered.? There is only one Erma and to be even remotely in her same class as a writer is wonderful.? Interestingly this is not the first time I have heard this compliment.? I have always admired Erma?s ability to take the mundane and find humor.? ? I also admire her style of writing free of swearing.? In today?s land of humor writers most use profanity to get the biggest laugh.? Erma?s writing was done in a time before swearing was so commonplace.

My friend Joanne sent me one of her favorite writing pieces from Erma and I thought I would share it with you.? The piece is about friendship.? The kind of friendship that needs no words for understanding.? Thanks to Joanne for her kind words about my blog and for reminding what a great american talent Erma was.

FRIENDS UNDERSTAND THE FUTILITY OF WORDS

For over 40 years (How about 47 years), I have had the best friend you could ever have.

When I told my best friend I was fat, she never said, ?I just lost three pounds without even trying.?

When we went to a sock hop together in college and she was offered a ride home, she never ditched me.

When I gave myself a home permanent and left it on too long, she was the only one to sit with me in the bathroom until it grew out.

When I told my best friend my husband gave me two snow tires for our anniversary, she never said, ?You should be happy he remembered.?

When I was pregnant and my stomach looked like a tray on a car door in a drive-in, she never said, ?There?s a glow about pregnant women.?

When I had a miscarriage and everyone else in the world said, ?There will be others babies,? she cried with me over the one I lost.

When she told me she was staying home for the summer, I wouldn?t have dreamed of sending her a card from Spain telling her what a great time I was having.

When her mixer broke down, I never asked her if she had sent in the warranty card so she?d be covered.

When I moved 3,000 miles away, she never once told me what I was doing to her.

When her mother died, I never said, ?She had a rich, full life and she was in her 70s.?

When I argued with my husband and begged her for advice, she kept her mouth shut. She just listened.

When we couldn?t get a sitter and had to bring the kids along to her house for dinner, she never fell apart.

When I had my first autographing party and no one showed up, she never once suggested, ?They probably didn?t see the ad.?

When her political candidate lost and mine won, I never said, ?Ha ha, I told you so.?

Every time we got together, neither of us had to say, ?I?m glad to see you.?

When she was up to her armpits in snow, I never called to say, ?The sun is shining here.?

Recently, my best friend lost her child. He was her youngest and was in his 20s.

I listened to her.

I cried with her.

I felt pain that I had never known that I could feel before.

But not once did I say to her, ?I know how you feel.?

&#39;Skyfall&#39; Review: Has Bond Ever Been Better?

To borrow a line from Depeche Mode, death is everywhere in "Skyfall." James Bond's mortality has never been in such prominent focus, but the demise of the entire British spy game as we know it seems imminent, as well.

Still, this 23rd entry in the enduring James Bond franchise is no downer. Far from it: simultaneously thrilling and meaty, this is easily one of the best entries ever in the 50-year, 23-film series, led once again by an actor who's the best Bond yet in Daniel Craig. So many of the elements you want to see in a Bond film exist here: the car, the tuxedo, the martini, the exotic locations filled with gorgeous women. Adele's smoky, smoldering theme song over the titles harkens to the classic 007 tales of the 1960s, even as the film's central threat of cyberterrorism, perpetrated by an elusive figure who's seemingly everywhere and can't be pinned down, couldn't be more relevant.

And yet "Skyfall" seems like it could stand on its own perhaps more than most Bond movies. In the hands of director Sam Mendes, it almost feels like a reinvention; he has said making "Skyfall" left him "knackered," but audiences will leave feeling invigorated. And with Mendes collaborating once again with the great cinematographer Roger Deakins, it's definitely the most gorgeous.

Deakins, who also shot Mendes' "Jarhead" and "Revolutionary Road," provides a varied array of looks, all of them dazzling. The MI6 headquarters, which must be moved to a hidden underground location following a vicious attack, have a crisp and stylish industrial-loft chic about them. The rugged hills of Scotland, where the final battle occurs at Bond's ancestral home, are both wondrous and imposing; by this point in the film, "Skyfall" extends beyond the familiar confines of a spy thriller and becomes a flat-out Western. It's a bold move.

But the most beautiful sequence of all plays out in an empty office space in a Shanghai skyscraper: a mesmerizing mix of cool glass surfaces, delicate projected images and bold color, reminiscent of the lush hues in Mendes' "Road to Perdition." Within this precise setting, Mendes knows well enough to let the hand-to-hand combat between Bond and a sniper unfold without the kind of needless edits that unfortunately have become so popular in action films these days.

Bond being Bond, he can still get himself out of any dangerous situation; the opening chase, which begins in Istanbul's Grand Bazaar and ends in impossibly daring fashion on top of a hurtling train, is a marvel of timing and choreography. Conversely, he can also talk himself into situation, as he does when he seduces the beautiful and dangerous Severine (Berenice Marlohe) after meeting her in a Macau casino.

But Bond's vulnerability ? dare we say, his weakness at times ? makes him a much more complicated and captivating figure. He's not always totally smooth and slick. The work is taking a physical and psychological toll. Muscular and sexy as Craig is, he looks beat-up and worn-out here, which adds what feels like an unprecedented sense of depth to a character we thought we'd known so well for so long. Three films into the series and Craig owns this iconic role by now, with his stoic cool and willingness to explore a dark side.

This time, James Bond must try and protect his no-nonsense boss, M, from what feels like a very personal attack, even as it seems that she may not necessarily be protecting him in return. The always whip-smart and dignified Judi Dench gets to explore her character's hidden fears in the script from Neal Purvis & Robert Wade and John Logan, which adds some unexpected and welcome layers to her performance, as well. Ralph Fiennes, as M's new superior, questions her ability to lead this aging behemoth of an agency in an increasingly unstable environment; at the same time, Ben Whishaw provides some welcome, subtle humor as young gadget guru Q, whose modern-day specialty is computer hacking.

And then there is Javier Bardem, who pretty much steals this entire movie away from these esteemed and formidable actors. He is, totally unsurprisingly, tremendous as the villainous Silva, the former MI6 agent getting his revenge against this staid, old-fashioned organization in high-tech, ultra-efficient ways that make him seem unstoppable. Like so many Bond bad guys, he wants world domination through orchestrated chaos. But he approaches the role with a mix of effeminate flamboyance and cold-blooded menace. He's hilarious and terrifying ? and that's just in the beautifully shot monologue in which he introduces himself with touches of The Joker in "The Dark Knight" and Bardem's own Anton Chigurh in "No Country for Old Men."

Ultimately, the reports of James Bond's death are greatly exaggerated. Fifty years later, nobody does it better.

"Skyfall," a Columbia Pictures release, is rated PG-13 for intense violent sequences throughout, some sexuality, language and smoking. Running time: 143 minutes. Four stars out of four.
